Professional community and measures to avoid conflicts of interest
The partners listed above have joined forces in the form of a partnership with limited professional liability for the permanent exercise of their profession.

Attorneys are prohibited from representing conflicting interests on the basis of professional regulations (Section 43a (4) BRAO). Before accepting a mandate, it is therefore always verified whether there is a conflict of interest.

Contractual clauses on the law applicable to contracts with us and the place of jurisdiction
In mandate and renumeration agreements, in particular with foreign clients, we generally use the following contractual clauses in this regard:

Applicable law:
The law of the Federal Republic of Germany shall apply to this agreement, the matter of its conclusion and all claims arising from or in connection with this agreement, as it would apply between German nationals.

Place of jurisdiction:
The place of jurisdiction for all disputes arising from or in connection with this agreement – even after its termination – shall be Düsseldorf, provided that the client is a merchant or legal entity under public law or a special fund under public law or has no general place of jurisdiction in the Federal Republic of Germany. This place of jurisdiction shall be exclusive for all actions brought by the client against RellermeyerPartner; for actions brought by RellermeyerPartner against the client it shall optionally apply in addition to other legal places of jurisdiction.

Professional liability insurance
Professional liability insurance is provided by ALLCURA Versicherungs-AG in Hamburg. The geographical scope of the insurance cover covers activities in the member states of the European Union and thus satisfies at least the requirements of Section 51 of the Federal Lawyers’ Act (BRAO).

Out-of-court settlement of disputes
In the event of disputes between lawyers and their clients, it is possible, upon re-quest, to settle disputes out of court at the Düsseldorf Regional Bar Association (pursuant to Section 73 (2) No. 3 in conjunction with Section 73 (5) BRAO) or at the Arbitration Board of the Bar (Section 191f BRAO), which has been set up at the Federal Bar Association, on the Internet via its homepage (www.s-d-r.org).
